1. TERMS

By using the ListYourTops.com website, you are agreeing to the following terms of use/service.

These Terms apply to anyone who uses the ListYourTops website.  They are designed to eliminate spamming and attempt to create a fun and positive experience.  By your continuing use of the service, you're agreeing to these terms.

2. DESCRIPTION OF SERVICE

ListYourTops is a collection of ListYourTops, created by you and other community users.  The ability to create and rate ListYourTops, show favorites, and create a custom account page with the ability to include links to other websites gives the users a level of control on how the website develops.

In order to use the Service, including new services or functionality that will be made available by ListYourTops from time to time, Registered Users must abide by these Terms of Service. If a user fails to follow these rules, ListYourTops can discontinue their ability to use the Service entirely. In addition, we have the right to delete your account and corresponding ListYourTops without notice if we see evidence of abuse or other inappropriate activity.  Please keep this a fun place so we don’t have to interfere with its natural development.

Registering: You will be responsible for any activities that take place under your name and password.  It is up to you to maintain the confidentiality of your password and account. ListYourTops is not liable for any loss or damage arising from your failure to comply with the provisions of these Terms.

Privacy: You also understand and agree that as part of the Service, you may receive certain communications from ListYourTops, such as account creation confirmations, service announcements, and administrative messages.  We won’t abuse your inbox, but we may need to communicate with you in the future. If you don’t want to receive ANY messages from us, you will need to cancel your account.  Of course, ListYourTops promises to never rent or sell your personal information, and you will never receive email from a third party as a result of your relationship with us, unless you explicitly opt in to do so.

Other users can see the website link and comments on your account page.  If you do not want other people seeing this information, leave the fields blank.

3. THE RULES

Here are the big picture rules. Please remember that ListYourTops reserves the right to cancel your account if we suspect that you're spamming, sharing illegal content, abusing or maligning another community member or individual, or any other activities that don't fit the spirit of the site. We’re not going to do this without fair cause.

• You are solely responsible for your conduct and any data, text, information, links, (“Content”) that you submit, post and display on the website.
• You cannot Spam. You cannot use your ListYourTops lists or our platform to spam or attack others online, on the site or off. This includes introducing viruses to the site, spamming bloggers, email spam to other registered users or others, and more.
• You also cannot create spam lists (multiple lists that carry the same content, lists that are irrelevant to the topic, lists that are uncurated and lifted from other sites, ListYourTops accounts with several lists trying to promote the same service on hundreds of matching lists, or anything the ListYourTops officials deem to be Spam). Period.
• You must not abuse, harass, threaten, malign, flame or intimidate others who use the Service, bloggers or others online. Nor may you upload, post or otherwise include any Content that is defamatory, libelous, tortuous, vulgar, obscene, invasive of privacy, racially or ethnically objectionable, hateful, promotes or provides instructional information about illegal activities.
• If ListYourTops staff believes your list to be grossly miscategorized, they reserve the right to re-categorize your list right away or lock it.
• You cannot create Lists or use the Service for any illegal or unauthorized purpose, or to promote or make solicitations for any illegal or unauthorized activity.
• You cannot use the Service to distribute, share or solicit Content belonging to third parties without proper authorization from the owner(s) of that Content. You must respect the proprietary and intellectual property rights of others (including trademark, copyright and trade secrecy) in creating your list. ListYourTops is a user created website and cannot endorse the content on our pages.
• You must not, in the use of ListYourTops, violate any Federal, state or local laws. If you are creating a List outside of the United States, you must comply with all local laws regarding online conduct and acceptable content
• You cannot attempt to automatically redirect surfers to other domains, mislead surfers of the origins of the content contained in your lists.
• You cannot interfere with or disrupt the Service, or any servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.
• ListYourTops reserves the right to change our rating algorithm at any time.

4. THE CONTENT: WHO OWNS IT?

By creating lists;

1. You declare that you are the sole owner and author of the list and own 100% of all copyrights pertaining to it.
2. Your list creation on ListYourTops.com gives unconditional permission for us to display and promote the list as part of the ListYourTops collection of lists.
3. Your list creation on ListYourTops.com also gives unconditional permission for the list to be reprinted in other ezines, websites and print publications. We ask publisher(s) to follow our reprint rules as stated below, but you acknowledge that the enforcement of our reprint rules is at your risk and cost and not ours. In other words, if someone violates your copyright -- it will be 100% up to you to take legal action against those who abuse your copyright to protect your interests. If you do not agree to these terms, do not create lists.

ListYourTops does not claim ownership of the Content you place in your List. The Content will be owned by you or a third party from whom you got permission to post the content. By placing Content in your List, however, you grant ListYourTops a worldwide, royalty-free, and non-exclusive license, for as long as your List is displayed on ListYourTops, to reproduce, display, modify, adapt and publish the Content solely for the purpose of displaying, distributing and promoting your List on ListYourTops.com. ListYourTops may preserve and store Content, and may also disclose Content if required to do so by law or if ListYourTops believes in good faith that such preservation or disclosure is reasonably necessary to: (a) comply with legal process (e.g., subpoenas); (b) enforce these Terms of Service; (c) respond to claims that any Content violates the rights of third parties; or (d) protect the rights, property, or personal safety of ListYourTops, its users and the public.

The List Creator, and not ListYourTops, will be fully responsible for all Content that is uploaded, posted, transmitted or otherwise made available by the List Creator. ListYourTops cannot guarantee the accuracy, integrity or quality of such Content. ListYourTops does not pre-screen Content, but will have the right (but not the obligation) in its sole discretion to refuse or remove any Content for any reason, including Content that may violate these Terms, or that is otherwise objectionable. ListYourTops also cannot take responsibility for anything that your surfers may do in reliance on the Content you post. Bottom line: if you create a List, you're responsible.

5. RESALE OF SERVICE

You agree not to hijack content from other lists, plagiarize, set up false accounts, spam or hack lists, duplicate lists on other services, or exploit other users by selling them false information or services about ListYourTops.

6. LISTYOURTOPS CAN MODIFY OR DISCONTINUE THE SERVICE

ListYourTops reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice, without liability to you or any third party.

7. LISTYOURTOPS CAN TERMINATE YOUR USE OF THE SERVICE

ListYourTops, in its sole discretion, may terminate your password, account or use of or access to the website and remove and discard any List, for any reason.

8. REPRINT RULES

If you wish to publish/reprint any article from our site in your ezine, website, blog, forum, RSS feed or print publication, you must:

1. Respect the copyrights of the authors by publishing the entire list as it is with no changes.
2. Agree not to change the title or content of the list in any way.
3. Agree to include the list source credit below each list reprinted with the link active.
4. Agree to not put any of the lists found on this site to any web site that also contains warez, illegal mp3 or other files, instructions on how to make bombs or steal, or expressions that promote hatred or profanity or racism or bigotry, or contains pornography or exploits children or animals or any human, or any other unlawful activities.
5. Agree to never reprint any list from this site via any unsolicited email, spamming, or pop up ads.
6. Agree to never translate any content from our site in any language. You may not create derivative works from any of our content.

7.      Agree to not add any active links to any list you reprint from our site. This unethical behavior would lead someone to believe falsely that the author of the list endorses the active link when in fact there is no truth to that.

 Your use of anything connected to ListYourTops.com, our newsletter, our RSS feed or our website is completely at your own risk.

While ListYourTops does not generally own the copyright to the lists found within our site, we do have permission for publishing them.

No additional permission is required from the author of any list within our directory as long as you agree to every term listed above in section.

9. DISCLAIMER OF WARRANTIES

The Service is provided on an "as is" and "as available" basis. You expressly understand and agree that your use of the Service is at your sole risk. ListYourTops expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. ListYourTops makes no warranty that the service will be uninterrupted, timely, secure, or error-free, or that the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations.

10. LIMITATION OF LIABILITY

You expressly understand and agree that ListYourTops will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if advised of the possibility of such damages), resulting from the use or the inability to use the Service, unauthorized access to or alteration of your transmissions or data, statements or conduct of any third party on the Service, or any other matter relating to the Service.

ListYourTops.com reserves the right to modify these Terms of Service at any time without prior warning.
